Billy Hyatt and Aaron Vick who are CEO and Chief Strategy Officer of Cicayda - a US eDiscovery provider, are paying a flying visit to SA and will be with me in CT for a short time.
With growing interest in the use of Arbitration in SA here's a practical look at why eDiscovery technology is essential in this area.
As far as I know there has never been a decided case anywhere in the world on this which says a great deal. Indeed if taken to an illogical conclusion then there would be no outsourcing anywhere at all!
What is needed to make SA the global centre for managed document review? Probably not that much I would suggest.
It is always pleasing when one is asked to write an article on a particular topic but especially so for me, when 3 SA individual contacts and one SA law firm have specifically asked to me to write this one.
Technology does not decide on relevance, privilege etc. only lawyers do that, but technology helps to find those documents quicker and in a less expensive and more reliable manner than the old way.
If the amendments are made then it will mean that SA would be the first developing country to adopt eDiscovery rules and I would be mightily proud of that.
Social Media in terms of discovery for litigation, investigations, competition cases and, of course criminal investigations is a huge, huge topic - arguably one of the biggest in our industry at the moment.
